⚠️ WARNING — READ CAREFULLY BEFORE AGREEING

By agreeing below you give up certain legal rights, including the right to sue or claim compensation following an accident. This is a binding legal agreement. Please ask any questions before agreeing, and seek independent legal advice if you wish.

This is the full STCS Participant Waiver, Release of Liability and Assumption of Risk (Adult Form). Please read it in full.

Program Participation

I, the undersigned (the "Participant"), wish to participate in tennis programs, lessons, clinics, drop-in play, ladder and league play, tournaments, social events, and other activities (collectively the "Activities") organized by, sponsored by, or held under the name of the Squamish Tennis Club Society ("STCS"). This Waiver is required as a condition of participation in STCS Activities, adopted by the Board of Directors under the authority of Part 2 (Membership) and Part 4 (Directors) of the STCS Bylaws, and pursuant to the Society's powers under the Societies Act (British Columbia).

Assumption of Risk

I understand and acknowledge that tennis and related Activities involve inherent risks, dangers, and hazards which may result in injury, property damage, or in rare cases death. These risks include, but are not limited to: slips, trips, and falls on or near the courts; being struck by tennis balls, racquets, or other equipment; collisions with other participants, fixtures, or surroundings; strains, sprains, fractures, and other musculoskeletal injuries; heat, cold, sun, weather conditions, and environmental hazards; pre-existing medical conditions aggravated by physical activity; negligence of other participants, coaches, officials, volunteers, or third parties; and travel to and from Activity locations. I FREELY ACCEPT AND ASSUME ALL SUCH RISKS, including the risk of injury, loss, or damage that may result from my participation, and I take full responsibility for any such injury, loss, or damage.

Release of Liability and Waiver of Claims

In consideration of being permitted to participate in the Activities, I agree: to waive any and all claims that I have, or may in the future have, against the Squamish Tennis Club Society, its directors, officers, employees, members, volunteers, coaches, contractors, agents, representatives, sponsors, and any owner or operator of premises used for the Activities, including the District of Squamish (collectively, the "Releasees"); to release the Releasees from any and all liability for any loss, damage, expense, or injury, including death, that I may suffer, or that my next of kin may suffer, as a result of my participation in the Activities, due to any cause whatsoever, including negligence on the part of the Releasees; to hold harmless and indemnify the Releasees from any and all liability for any damage to property of, or personal injury to, any third party resulting from my participation in the Activities; and that this Waiver shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.

Code of Conduct

I agree to abide by the STCS Code of Conduct, Anti-Harassment & Safe Sport Policy, the rules of the facility, and the directions of STCS coaches, officials, and volunteers. I understand that failure to do so may result in my suspension or removal from the Activities without refund.

Photo and Media Release

I consent to STCS photographing or recording my image at Activities, and to STCS using such images for the Society's website, social media, newsletters, publicity, and promotional materials, without compensation. If I do NOT consent to this use, I will check the opt-out box below.

Personal Information

I consent to STCS collecting and using my personal information for the purposes of administering my participation in the Activities, communicating with me about STCS matters, and complying with the Society's legal obligations. STCS will handle my personal information in accordance with its Privacy Policy and the BC Personal Information Protection Act.

Governing Law

This Waiver shall be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Any disputes arising out of or in connection with this Waiver shall be resolved in the courts of British Columbia.

Acknowledgment

By agreeing below, I confirm that: I have read and understood this entire Waiver; I am 19 years of age or older (the age of majority in British Columbia); I am agreeing freely and voluntarily, without inducement, assurance, or guarantee being made to me; I understand that I am giving up substantial legal rights, including the right to sue the Releasees; and I have had the opportunity to ask questions and to seek independent legal advice before agreeing.

Registering a player under 19? By law in British Columbia, a parent or guardian cannot waive a minor's right to sue — so minors do not use this adult waiver.
