Activities Covered

This agreement applies to all STCS activities, including but not limited to: open play, social play, club nights, lessons, clinics, camps, leagues, ladders, tournaments, social events, fundraisers, AGMs, volunteer activities, and travel to and from any STCS event or competition (collectively, the "Activities").

Assumption of Risk

I acknowledge that tennis and related club activities involve risks of physical injury, including but not limited to: slips, trips and falls; collisions with other players, fences, posts or equipment; impact from tennis balls or rackets; muscle strains, sprains, joint injuries and fractures; heat exhaustion, dehydration or hypothermia; sun exposure; effects of weather; and hazards arising from court surface conditions, lighting, or equipment. I understand these risks and voluntarily assume all such risks, whether known or unknown, foreseen or unforeseen, including those caused by ordinary negligence.

Physical Fitness

I confirm that I am physically fit and have no medical condition that would prevent safe participation in tennis. If I have any doubt about my fitness, I have consulted a physician before participating. I will inform the club of any relevant health condition that may affect my safety on court.

Facility & Equipment Acknowledgment

I understand that the courts at Brennan Park Recreation Centre are operated by the District of Squamish, and that STCS does not own or maintain the facility. I agree to inspect the courts and equipment before each use and to report any unsafe conditions. I will not use the facility if I believe conditions are unsafe.

Release of Liability

In consideration of being permitted to participate in STCS Activities, I release, waive, covenant not to sue, and forever discharge the Squamish Tennis Club Society, its directors, officers, employees, volunteers, agents, sponsors, members, and the District of Squamish (the "Released Parties") from any and all liability, claims, demands, actions and causes of action arising from injury, loss or damage suffered by me as a result of my participation in the Activities, including injury caused by the negligence, gross negligence, breach of contract, or breach of any statutory duty of care of the Released Parties. This release extends to my heirs, executors, administrators, family members, spouse, children, and assigns.

Indemnity

If, despite this agreement, I or anyone on my behalf makes a claim against any of the Released Parties, I agree to indemnify, save and hold harmless the Released Parties from any litigation expenses, legal fees, loss, liability, damage or costs they may incur as a result of such claim, to the fullest extent permitted by law.

Conduct of Other Participants

I understand that STCS does not control the conduct of other members or guests. I agree that the Released Parties are not responsible for the actions of other participants on or off the court.

Members Under 18

If the member is under 18 years of age, this waiver must be signed by a parent or legal guardian. The parent or guardian agrees to all terms on behalf of the minor and personally as a participant in the consent and release.

Media Consent

I consent to STCS photographing, recording or filming activities in which I participate, and using such images and recordings for promotional and educational purposes, including on the STCS website, social media, newsletters, and grant applications. I may withdraw this consent at any time by writing to the club.

Privacy

STCS collects your personal information solely for membership administration, club communications, and safety purposes (including emergency contact). We do not sell or share your information with third parties without your consent. You may request access to or correction of your information, or unsubscribe from communications, at any time by contacting info@squamishtennis.ca.

Governing Law

This agreement is governed by the laws of the Province of British Columbia and the laws of Canada applicable in BC. Any disputes will be resolved in the courts of British Columbia. If any provision is held unenforceable, the remaining provisions remain in full effect.

Acknowledgment

I have read this agreement carefully, understand its terms, and sign it voluntarily. I confirm that: (a) I have been given sufficient time to read this agreement; (b) I have had the opportunity to seek independent legal advice before signing; (c) I understand that I am giving up substantial legal rights, including the right to sue for negligence; and (d) STCS would not permit me to participate without my agreement to these terms.
